10th Circuit Court Says Banning Same-sex Marriage Is Unconstitutional

The ruling just came down from the 10th Circuit Court Of Appeals regarding the State of Utah's efforts to ban same-sex marriage. Their words are pretty simple and direct.

"We hold that the Fourteenth Amendment protects the fundamental right to marry, establish a family, raise children, and enjoy the full protection of a state's marital laws. A state may not deny the issuance of a marriage license to two persons, or refuse to recognize their marriage, based solely upon the sex of the persons in the marriage union."

Well, actually it is not simple and direct at all. That is just a quote. If you are a legal junkie, here it is in all its 100 page glory. 

The ruling is on hold pending appeal. Salt Lake County Clerk Sherrie Swenson said that they are not issuing licenses at this time. There is obviously a lot to sort out.
